TN visa is a non-immigrant classification
The TN visa classification was created as a result of the North American Free Trade
Agreement (NAFTA), and it allows Mexican and Canadian citizens to temporarily work in the
U.S. in a professional capacity. Under the agreement, qualified professionals must have a
college degree and the appropriate credentials to prove their status as a professional. The
duration of the initial stay in TN status is three (3) years, but it may be extended.
While a TN visa does not lead to a green card, it can be used to apply for adjustment of status
(AOS) or for an immigrant visa abroad. These are both important options to consider if you
plan to stay in the U.S. for a long period of time. However, it is important to understand your
rights and the requirements for each. Listed below are some important facts about TN visas.
The TN visa is a non-immigration classification that permits qualified Mexican and Canadian

citizens to enter the U.S. without the tedious petition process. TN status is granted in three-
year increments, and is renewable indefinitely. TN/TD statuses can also be extended to allow

the holder to work and study in the U.S. They are also able to sponsor dependents of TN visa
holders.
To apply for a TN visa, you must be employed at a college or university in the United States. In
order to apply for a TN visa, the hiring college must notify the Immigration Specialist that it is
interested in the TN candidate and submit a Request to Petition form. The Immigration
Specialist will review the candidate’s qualifications and petition for the appropriate personnel.
If the candidate meets the requirements, the immigration specialist will then review the
candidate’s petition and accept them into the U.S.
TN visa is issued to Mexican citizens who meet certain criteria. They must apply for a TN visa
at a U.S. embassy or consulate, and undergo an interview with the immigration officer. After
being approved, they will receive a TN visa number and seek entry at a U.S. port of entry.
These people must have the proper documentation to legally work in the United States.

professions

The TN classification is for persons who practice a specific profession, or one that is closely
related. The TN classification differs from the H-1b specialty occupation concept in that the
beneficiary must describe the nature of the position he or she is applying for. In contrast, the
TN classification requires that the applicant demonstrate his or her qualifications for the
profession, job opening, and credentials. The person must complete a credential evaluation
service, a form which must be completed within the last five years, and must be in good
standing with the relevant professional organizations.
This classification includes business people, salaried employees of Canadian enterprises, and
independent contractors. More than 60 occupations are listed in Appendix 1603.D.1 of the
Agreement. In addition to a NAFTA-approved profession, a professional may be a salaried
employee of a Canadian enterprise, a freelancer, or a business person. Professionals do not
need to apply for a labor market impact assessment (LMIA) and work permit. However, they
must apply for a temporary resident visa before arriving in Canada.
